Your Questions
You don’t have to instruct solicitors, but, if you want expert guidance and support in navigating the complex world of litigation, then it is advised.
The general rule is that you cannot recover solicitors fees, even if you win in a case that has been classed as a small claim. Some claims are subject to fixed cost, which means you can only recover a predetermined amount as set out in the court rules. You may be entitled to a recovery of some costs such as Court fees.
Each case is different and it is extremely difficult to provide a clear answer to this question. Factors beyond our control such as staff shortages or backlogs at your local Court, uncooperative or unavailable witnesses, and even unreasonable opponents or parties to the dispute can cause delays.
We always endeavour to act as efficiently and in your best interests to resolve the dispute as soon as possible.
Our solicitors are happy to provide as much or as little assistance as you may require in helping you to reach a resolution to your dispute. We can advise on the strengths and weaknesses of your case, which in turn, will help you to evaluate the merits of engaging in what can sometimes be costly litigation.
We can provide advice on alternatives to litigation (“ADR”) and. where appropriate, advise on making a fair and reasonable offer to try and resolve matters in the most efficient manner. Where you require a robust approach, we are ready to help and will present your case rigorously, acting in your best interests at all times.
