For some private family law matters, you may need to provide documentary evidence that you or your children have experienced, or are at risk of experiencing, domestic abuse.

Examples of evidence which may be accepted include:

• a protective injunction, court order or undertaking;
• a criminal conviction, caution, charge or ongoing criminal proceedings relating to domestic abuse;
• findings made by a court concerning abusive behaviour;
• evidence from the police;
• confirmation from a Multi-Agency Risk Assessment Conference, commonly known as a MARAC;
• evidence from social services or another public authority;
• evidence from a doctor, nurse, midwife, psychologist or other health professional;
• evidence from a domestic abuse support organisation;
• confirmation of admission to, or assistance sought from, a refuge;
• evidence from an employer, education provider or benefits provider; and
• relevant financial evidence demonstrating economic or financial abuse.

This is not an exhaustive list. The evidence required will depend upon the type of proceedings and your individual circumstances. You do not need to obtain all of the evidence listed above, and you may speak to us before obtaining it. We can advise you about what evidence may be suitable and how it can be obtained.
