The general rule is that you cannot recover solicitors fees, even if you win in a case that has been classed as a small claim. Some claims are subject to fixed cost, which means you can only recover a predetermined amount as set out in the court rules. You may be entitled to a recovery of some costs such as Court fees.

Each case is different and it is extremely difficult to provide a clear answer to this question. Factors beyond our control such as staff shortages or backlogs at your local Court, uncooperative or unavailable witnesses, and even unreasonable opponents or parties to the dispute can cause delays.
